Google Books - update

30 Sep 2009

The American Author's Guild has asked for an adjournment of the fairness hearing scheduled for 7th October 2009, based on ongoing negotiations with the Department of Justice that will significantly change the existing settlement.

There have been many objections to the current agreement. Objectors voicing concern over significant issues include prominent authors, law professors, non-profit organisations, countries and states.

The Department of Justice and supporters of the settlement feel the proposed settlement would offer many benefits to society. Says the Department of Justice Statement of interest, "The Proposed settlement has the potential to breathe life into millions of works that are now effectively off limits to the public."

The public may well benefit with a fair and reasonable settlement.

The Court will not proceed with the fairness hearing on 7th October 2009 as it doesn't appear that the current settlement will be the operative one. Google made no objection. However, the Court will conduct a conference to determine how best to proceed with the case, which has been pending for over four years.
Objectors and supporters are able to attend the conference, but their arguments will not be heard.
